Unplug your brake lamp switch (near the pedal) and see if the lights turn off. These are common Nissan failure items, but the new switch only costs a few $$ and should last for another 100K or so.
Wait a minute... are you talking about the rear brake lamps or the one on the dash? If it's the dash lamp, it doubles as a low fluid indicator for the master cylinder. Check your fluid levels.
