Spec V DTC P0420

so I just bought this '02 spec V and the more I drive it, the more i realize that the previous owner thrashed it. Now I have this DTC of P0420-catalyst efficiency. If I end up having to replace the pre-cat, the one integrated into the header, can I use any after market header with the cat built in?
And will it pass the annual smog check since I am essentially changing the emissions system? I live in Nevada so I dont have to worry about the Californication laws.

You want to get rid of the pre-cat. It has a tendency to break up, get sucked back into the engine, doing some damage to your engine.
