AIV, can i take it off?

so can i or cant i take the AIV off so i can put an open element air filter on if i still have a stock carb?
if i have to leave it on then is there any thing i can do to my engine to get more horses? besides fliping over the top over the top of the air box.

ifyou have smog checks then leave it. if you dont have any emmissions worries then have at it
