ECU having a memory?

I've read on Marylands Motor Vehicle Site that your car will not pass emissions if any error codes in the memory of your ECU are recovered during testing pertaining to emissions.

Has anyone else heard about this anywhere else?
Does the 02+ Spec V ECU have a memory component that can not be wiped out or is it just an old code that you haven't cleared?
